Under the various Acts relating to IP Nigeria, the owner of a registered right is given the exclusive right to use it in relation to the particulars of registration and any unauthorized use allows the owner to sue for infringement.

Where the trademark is not registered, the proprietor’s right of action lies in the common law tort of passing off.
